This post discusses a DUI of man in driveway. The Supreme Court of Virginia has ruled that a man can be convicted of DUI after he was found asleep by the police behind the wheel of his vehicle, in his driveway, and with the radio playing. Justice Lemons opined that the Virginia DUI statute does not require that an individual “be on a highway” for the court to consider the operation of a vehicle.

While the implied consent law may not apply, people need to be aware that vehicle operation while under the influence of alcohol on private property can still lead to a DUI conviction.
